We appreciate your business and are honored that you have chosen us to be a part of your special Celebration.

 

These Terms and Conditions serve as a contract between the client and Special Treats by Tanya. By paying the invoice the client is agreeing to these terms and conditions.

PRICE AND PAYMENT TERMS

• All Sales are Final

• All payments are non-refundable

• A retainer fee of 50% of the total order price is due upon signing the Agreement.

• The initial retainer reserves your event date is non-refundable and non-transferable. Its monetary value cannot be applied to other orders.

• A retainer fee of 50% of the price is due upon signing of the Agreement.  The retainer fee must be paid within 24hrs of receipt. The full amount of the balance of the purchase price as stated in the Agreement is due 14 calendar days (2 weeks) before your event. Failure to pay on time may result in your order being canceled, at Special Treats at Tanya's discretion.

• All payments will be paid via invoice.  Accepted forms of payment include all major credit cards and all payments shall be in United States currency.

• If the client misses a final payment on the initial due date, there will be an additional 25% charge to the total that is due if the client is still wanting the order to be processed.

• Special Treats by Tanya is not responsible for Customer not having cake/desserts if Customer has failed to timely make in full all payments and retainers required prior to the event, by the deadlines stated in the Agreement.

• Orders totaling $100.00 or less are to be paid for in full at the time of placing the order.

• Delivery and set up is an additional cost

CANCELLATION & REFUND POLICY

• Special Treats by Tanya will not offer refunds or exchanges for custom products that meet our quality standards once an order has been picked up or delivered and ACCEPTED by the client or another designated party.

• All products are the responsibility of the client once they leave the possession of Special Treats by Tanya.

• Refund requests due to color shade, decorating style, or general design will not be honored or considered.

• If you are not happy with your cake/desserts, please let us know at the time you receive your order.  Once your order is accepted refunds will not be considered.

• If cancellation is made within 14 days (2 weeks) client will not receive credit or any type of refund and all payments made are forfeited.

• As indicated above, should the client cancel the cake/dessert order before full payment has been made, the retainer fee to hold your date is non-refundable and will be forfeited.  Should you cancel your cake order after additional payments have been made and production has begun, you will be refunded your money, less the cost of supplies already purchased, expenses incurred and the amount of the initial retainer fee. This includes cancellation for any reason. A refund will be sent within 60 days of the cancellation.

•  In the unlikely event that Special Treats by Tanya has to cancel your order for any reason, then we will give the client as much notice as possible and discuss the matter with you and try to agree a suitable alternative. If the client is not willing to accept Special Treats by Tanya's suggested alternative, then we will refund the full price to you minus the retainer fee. within 60 days of the cancellation.

• Upon the event of a natural disaster, accident, or other situation outside Special Treats by Tanya control, this contract may be terminated.

CHANGES TO THE CAKE/DESSERTS

Special Treats by Tanya guarantees the flavor, size, and general design elements will be met as previously outlined.

• The date of your final payment is the final date for any changes to your order. This includes changes to the number of items, size of cake, style, or flavors. Any changes requested cannot be guaranteed and may be subject to additional charges. Any additional charges will be charged via an additional invoice and payment is required upon receipt.

• All changes must be provided in writing via Email only.

• All changes are subject to availability and approval by Special Treats by Tanya.

DESIGN VARIATION

• Special Treats by Tanya makes every effort to provide the exact size, color, shape, and design discussed during consultations. Creating a cake is an art form and may be subject to variations in the final design.

• If a client provides a photograph or inspiration to be used Special Treats by Tanya will make every effort to use these pieces as inspiration only to create something truly unique for your celebration.

• Special Treats by Tanya will NOT copy another artist's design but will use it as inspiration to create something special for your celebration.

• Client agrees that Special Treats by Tanya can make adjustments as needed to make cake/desserts as close to the design that was created during consultation.

• Although Special Treats by Tanya attempts to match colors exactly, custom cakes/treats are a work of art that include different edible mediums and different sugar mediums take color differently.

•  Special Treats by Tanya may not be able to match an exact shade of color 100% but we will come as close as possible. The final product may be subject to slight variations in color.

• Dark colors will sometimes taste bitter or can stain.

• Special Treats by Tanya cannot match a “verbal” color or a color that is sent via an electronic device, as all devices display colors differently. To attempt to color match client must provide a color swatch.

LIABILITY

• Special Treats by Tanya is not responsible for damages to your order once it has been picked up or after set up has been completed.

• If the client or representative elects to pick up the order client/representative assumes all liability and responsibility for the condition of your order once it leaves the possession of Special Treats by Tanya.

• Special Treats by Tanya is not responsible for damage to your order, or shortage of cake/desserts, caused by a guest, caterer, or any other person not employed by Special Treats by Tanya.

• The client is responsible for making sure all non-edible items(florals, toppers, cake dowels etc.) you have requested on your cake as decoration, are removed from the cake before it is cut and served. A spec sheet will be provided with each order describing nonedible items that should be removed prior to serving.

• The client is responsible for providing an appropriate and secure and sturdy table, and environment for the cake/desserts. Cake and desserts should not be in direct sunlight and should be placed in a room with an optimal temperature of 75 degrees Fahrenheit or below.

• The client acknowledges that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.

• When choosing a cake topper please take into consideration its weight, balance, and the fact that it will be sitting on top of a soft cake. Special Treats by Tanya is not responsible for any damage to the cake, or the topper should it fall off the cake or sink into the cake.

• Special Treats by Tanya is not ​responsible for what happens to the cake should Customer choose to have the cake set up outdoors or indoors in extreme conditions (e.g., effects of weather, insects, and animals).

• In the case of an unavoidable occurrence such as an act of God, a car accident, poor road conditions, or the dropping of cake during delivery Special Treats by Tanya cannot be held liable for more than the price of the cake/desserts described in this order.

• Special Treats by Tanya is not liable for non-performance on this contract if non-performance is attributed to labor trouble, disputes, strikes, accidents, governmental (federal, state, municipal) regulations of, or restrictions upon travel, or transportation, or non-available food, beverage, or supplies, riots, national emergencies, pandemics, acts of God, and other causes whether enumerated herein or not, which are beyond the reasonable control of Special treats by Tanya, preventing or interfering with Special Treats by Tanya performance.

ALLERGENS

• Please be aware although we have strict processes in place to prevent cross-contact there is still a slight risk of the presence of an allergen.

• As a licensed home baker, Special Treats by Tanya takes every precaution to prepare your food safely. However, our bakery may come into contact with the following items:

WHEAT, GLUTEN, MILK, DAIRY, EGGS, SOY, CORN, PEANUTS, TREE NUTS, SESAME SEEDS/OIL.

• Special Treats by Tanya may also come into contact with the use of artificial dyes, chemicals, sulfites, msg, flavoring, and preservatives.

•  It is the responsibility of the Client and/or cake recipient to become aware of allergy issues of guests and to inform his/her guests of this fact. Special Treats by Tanya does not guarantee any cake to be allergen free and is not responsible for any allergic reactions.

• Client agrees to hold Special Treats by Tanya harmless from any and all damage and legal fees and costs that result from the failure of client/cake recipient to take appropriate steps to avoid the issues and reactions referred to above.

By completing your payment and processing our order you agree to hold Special Treats by Tanya NOT liable for any allergens or foodborne illnesses that may result from you or your guests/attendees in relation to this order. At Special Treats by Tanya, we work hard to try and give you the best experience with our products and look forward to serving you.

USE OF PHOTOGRAPHY

• Special Treats by Tanya will take photographs of all cakes/desserts and may order prints/copies of pictures and/or videos of cakes/desserts.

•  Special Treats by Tanyareserves the right to use any photographs and/or videos for their own reference or for display and/or promotion without the customer’s consent and no compensation shall be payable to Customer for same.

DELIVERY/PICK UP

The cake and/or other goods that you order from Special Treats by Tanya under the Agreement will be delivered on the date indicated in the agreement at a time to be agreed upon and that comports with Special Treats by Tanya delivery schedule.

​

• Delivery/pick-up date, time, and location will be verified two(2) days prior to your event date.

• Should Special Treats by Tanya have to wait at the delivery site then the Customer will be billed for the waiting time incurred at $25.00 for the first 15 minutes and $5.00 for each additional minute. Payment must be made via cash only as a requirement of the pickup.

• If a client is picking up an order and the order is not picked up within a 15-20 min window from the time that was agreed upon between the client and Special Treats by Tanya, the client will not be able to pick up the order until the next business day.

• The customer shall promptly notify Special Treats by Tanya of any change of date, time, and/or location of the event.

• Special Treats by Tanya will NOT be responsible for the cake (and any other products ordered) being late due to changes in date, time, and/or location unless adequate notice (at least 7 calendar days in advance of the delivery date) has been given by the customer to Special Treats by Tanya.

• If the client is to pick up the cake (and any other products ordered) and the client fails to do so on the date and time specified by the client/recipient, at Special Teats by Tanya's sole discretion, the cake and any other products ordered may be donated to an organization and may be selected by Special Treats by Tanya and client will still be responsible for the amount due under the agreement.

• All Cake/dessert orders that are delivered can be set out 1-3 hours prior to your event.

I ACKNOWLEDGE THAT I HAVE READ AND I AGREE TO THE TERMS SET OUT IN THE AGREEMENT.

I ACKNOWLEDGE THAT I AM THE PERSON RESPONSIBLE FOR ALL ACTIONS, COMMUNICATIONS,

AND PAYMENTS REGARDING THIS CAKE ORDER.
